New Senedd recall provisions come into force

Provisions of the Senedd Cymru (Member Accountability and Elections) Act 2026 take effect today, marking another step towards establishing a system for recalling Members of the Senedd.

The provisions activated include requirements relating to recall guidance and powers to make regulations governing recall polls.

The wider legislation provides for recall following certain criminal convictions or a Senedd decision based on a recommendation from its Standards of Conduct Committee.

Why it matters: Wales is developing a mechanism through which elected representatives could lose their seats before the next election following serious misconduct. This is a significant change to democratic accountability.

Status: Preparatory legal provisions are now in force. This does not mean the complete recall system is operational or that recall polls can immediately be held.
